DISCLAIMER: Caldwell Porchfest Participants acknowledge and accept that entry onto any property associated with Porchfest involves inherent risks of injury, damage, or loss, including but not limited to slips, falls, uneven terrain, weather conditions, or other hazards. Neither the Rotary Club of the Caldwells, Rotary International District 7475, Rotary International (hereinafter collectively referred to as “the Rotary Club”) nor the event organizers, volunteers, members, officers, affiliates or and/or agents of the Rotary Club shall be held liable for any injuries, damages, losses, or claims arising out of or in connection with my participant in Porchfest, except to the extent caused by willful misconduct or gross negligence. To the fullest extent permitted by law, the Participant hereby waives, releases, and discharges the Rotary Club from any and all claims, liabilities, demands, causes of action, or damages of any kind—whether for bodily injury, property damage, or otherwise—that may arise from or relate to their participation in Porchfest, except in cases of gross negligence or willful misconduct. The Participant agrees to indemnify and hold harmless the Rotary Club and the property owner(s) from any claims brought by third parties arising out of the Participant’s conduct in connection with Porchfest. The Participant acknowledges that neither the Rotary Club nor any property owner(s) make any warranties or representations regarding the condition, safety, or suitability of the property for any particular purpose, and enters at their own risk. The Borough of Caldwell is not an organizer or sponsor of Porchfest and is not liable for any costs, damages, and losses that may be claimed as a result of this event.
