To the fullest extent permitted by law, the Participant hereby waives, releases, and discharges the Rotary Club from any and all claims, liabilities, demands, causes of action, or damages of any kind—whether for bodily injury, property damage, or otherwise—that may arise from or relate to their participation in Porchfest, except in cases of gross negligence or willful misconduct. The Participant agrees to indemnify and hold harmless the Rotary Club and the property owner(s) from any claims brought by third parties arising out of the Participant’s conduct in connection with Porchfest. The Participant acknowledges that neither the Rotary Club nor any property owner(s) make any warranties or representations regarding the condition, safety, or suitability of the property for any particular purpose, and enters at their own risk. The Borough of Caldwell is not an organizer or sponsor of Porchfest and is not liable for any costs, damages, and losses that may be claimed as a result of this event.
